Amnesty International issues urgent call to save Soghra Najafpour

Following the comunications with Stop Child Executions Campaign, Amnesty International today issued an interntional urgent action to save Soghra najafpour from execution:

UA 271/07              Death penalty/ Fear of imminent execution

IRAN
Soghra Najafpour (f), aged 30

Soghra Najafpour is currently believed to be in hiding. If she is taken into custody, it is believed she could face imminent execution. She was sentenced to qesas (retribution) 18 years ago for a murder committed when she may have been only 13 years old. Soghra Najafpour was released on bail on 1 October, however, when the family of the victim found out about her release, they reportedly asked for her to be re-arrested and for the execution to take place.
At the age of nine, Soghra Najafpour was sent by her family to work as a servant in a doctor’s home in the northern city of Rasht . Four years later she was accused of the murder of the eight-year-old son of the family. Soghra Najafpour reportedly confessed to the murder during interrogation; soon afterwards, however, she denied that she was involved. Nevertheless she was sentenced to death, as the judge did not believe her to be innocent. At the age of 17, Soghra Najafpour was taken to be executed, but the family of the victim changed their mind at the last minute.

With the help of her new lawyer and human rights defender, Nasrin Sotoudeh, Soghra Najafpour’s case went before the courts again and a new judge authorized her release on bail. However, her bail stipulated that she would have to return to prison on order of the Judiciary. Soghra Najafpour was reportedly summoned to return to prison on 22 October 2007, following the complaint made by the family of the victim, but it appears that she has gone into hiding. According to reports, the father of the victim had recently agreed to pardon Soghra, however, his wife insisted that she be executed. Failing to reach an agreement between all the blood relatives of the victim, in this case the parents, Soghra Najafpour is at risk of imminent execution should she be detained by the authorities.

On 23 October, Nasrin Sotoudeh submitted an appeal to the Supreme Court calling for a review of the case of Soghra Najafpour, but it is not known whether it will be considered acceptable for submission.

BACKGROUND INFORMATION

International law strictly prohibits the use of the death penalty against people convicted of crimes committed when they were under 18. As a state party to the International Covenant on Civil and Political Rights (ICCPR) and the CRC, Iran has undertaken not to execute child offenders. However, since 1990, Iran has executed at least 24 child offenders. There are fears that at least two other executions may have taken place on 17 October 200. At least 77 child offenders are currently on death row in Iran. This number may be even higher as according to yet unconfirmed reports at least a further 15 Afghan child offenders may be under death sentence.
For more information about Amnesty International’s concerns regarding executions of child offenders in Iran, please see: Iran: The last executioner of children (MDE 13/059/2007, June 2007)

RECOMMENDED ACTION: Please send appeals to arrive as quickly as possible, in Persian, Arabic, English or your own language:
- calling on the Head of the Judiciary to urge the Supreme Court to review the procedures in the case of Soghra Najafpour, including the manner of the interrogation, which led to her initial conviction;
- expressing concern that, if she were to be taken into custody, Soghra Najafpour would be at risk of execution for a crime committed when she was under 18;
- calling on the Iranian authorities to immediately halt any efforts to proceed with the execution of Soghra Najafpour;
- calling for the death sentence against Soghra Najafpour to be commuted;
- reminding the authorities that Iran is a state party to the International Covenant on Civil and Political Rights and the Convention on the Rights of the Child, which prohibit the use of the death penalty against people convicted of crimes committed when they were under 18, and that the execution of Soghra Najafpour would therefore be a violation of international law;
- urging the authorities to pass legislation to abolish the death penalty for offences committed by anyone under the age of 18, so as to bring Iran’s domestic law into line with its obligations under international law;
- stating that Amnesty International acknowledges the right and responsibility of governments to bring to justice those suspected of criminal offences, but unconditionally opposes the death penalty.

URGENT: Soghra to be executed immediately, she is in hiding

Late last night ,the Stop Child Execution Campaign received an email from Nasrin Sotoudeh, the attorney of Soghra Najafpour stating that Soghra can be executed within 2 days (Iran Time). Immediately, Nazanin Afshin Jam called  Mrs. Sotoudeh for more detail :

After the parents of the alleged victim officially demanded Soghra’s execution, her family were notified that Soghra must report back to the prison authorities within 5 days. This was only 3 weeks after her release from prison on bail after 18 years of imprisonment. Once Soghra realized that upon return to prison she would be executed she ran away scared and has not been seen ever since.

At this time she has two more days to turn herself. Upon return to prison or arrest she will immediately be taken to be executed.

Meanwhile without disclosing her whereabouts, Soghra has made a phone call and stated that she is extremely scared and is on the verge of having an stroke and this situation is worse than death for her.

Soghra was imprisoned since the age of 12. She was once taken to be executed at the age of 17 but was saved because the alleged victim’s family changed their mind at the last minute. Soghra was freed on bail 3 weeks ago at the age of 30. All the attempts to mediate with the family of the alleged victim has failed and they have been insisting on Soghra’s execution.

Soghra is accused of killing the child of an influential doctor in the city of Rasht while she lived with the family as a maid, since the age of 9. Soghra has denied the charges. According to confirmed medical reports Soghra was also molested while living with the family. Although the Doctor has stated that he would be willing to pardon Soghra, his wife upon finding out about Soghra’s release has insisted on her execution, stating that by reporting the molestation 18 years ago Soghra had jeopardized the family’s name and honor. Nothing was done by Iranian authorities about the confirmed molestation charges except sentencing Soghra to death at the age of 13.

Stop Child Execution campaign has been in direct contact with Amnesty International in the past two days providing information about this case. SCE and Nazanin Afshin-Jam are also in process of contacting United Nations, European Union, Canadian authorities and other international organizations.

It is extremely important that everyone contact the media as well as international organizations and governments about Soghra’s imminent execution (visit SCE’s how you can help page for more information: http://www.stopchildexecutions.com/how-you-can-help.aspx )

Stop Child Execution condemns the renewal of the execution order of Soghra Najafpour and demand the government of Islamic republic of Iran to adhere to its obligations under the article 6.5 of International Covenant on Civil and Political Rights (ICCPR) and article 37(a) of the Convention on the Rights of the Child (CRC). We further request the United Nations, European Union and other world governments and organizations to demand the Iranian authorities to reverse and stop the executions order of Soghra and to give Soghra another chance to live her life in freedom after 18 years of imprisonment under the fear of death for the past 18 years.

URGENT CALL: Soghra facing imminent execution again!

Soghra Najafpour, the Iranian girl who was released from prison on bail after 18 years of being on the execution row , is facing imminent execution one more time. After constant efforts by Soghar’s attorney Mrs. Nasrin Sotoudeh and her ability to negotiate placing the deed a house as the security of the bail , Soghra was released only 3 weeks ago.
Soghra was arrested at the age of 12 and later sentenced to death by an Islamic judge in Iran for alleged murder of the son of a influential doctor in the northern city of Rasht.
The new Judge who recently authorized the release of Soghra stated in an interview with Iran’s Etemaad newspaper that there are other factors in Soghra’s file such as her age at the time of incident as well as “other matters” that were partially reflected in the 18 year old file. Judge Teymouri confirmed that the parents of the alleged victim have re-filed a demand for execution of Soghra again (ghisas) after they found out about Soghra’s release on bail.   Judge Teymouri added that since the execution order was ordered 17 years ago, the statue of limitation to file and appeal has passed. Iran’s sharia law leaves the option to exercise the execution to the family of the victims.
Soghra was once taken to be executed at the age of 17 but the parents changed their mind the last minute , however after finding out about her release, they have re-filed for her execution order again, 13 years later.

According to Teymouri at this point the only person who can reverse the execution order of Soghra is Iran’s head of judiciary Ayatollah Shahrudi. Teymouri added that although there are attempts to obtain the parents pardon however if they officially finalize the execution order, Soghra can be executed at any given moment.
Soghra has spend all her youth in prison and in anticipation of execution and she has denied involvement in the death of the child during the past 18 years.
Although Soghra does not have the right to appeal, however Iran’s law does allow the parents to choose execution of Soghra at anytime and therefore they can keep sending Soghra for execution (or release ) as they wish, without any statue of limitation to their demand or number of times they put Soghra through their life and death decisions.
Stop Child Execution Campaign has recently found out that although recently the father had accepted a pardon, the mother has insisted that Soghra should be executed. When asked why, her reason has been that 18 years ago Soghra accused her husband of sexual molestation while Soghra lived in the home as a maid since the age of 9.
The medical records from 18 years ago after Soghra’s testimony had verified that she was molested while living with the family but nothing was done about it due to the doctor’s influential family, versus family of Soghra who were homeless and lived in the Caspian sea forests of Iran.
Meanwhile the wife of the doctor has been insisting on Soghra’s execution because “Soghra jeopardized their family good name” !
The sharia law of Iran leaves the life and death decision of an accused in the hands of the alleged victim’s family who are emotionally involved in the case not to mention their other potential motives for their decisions.
Stop Child Execution is extremely concerned about potential imminent execution of Soghra and ask the head of Iran’s judiciary, Ayatollah Shahrudi to reverse the execution order and the so called ghisas right of the alleged victim’s parents in lieu of proven molestation of Soghra while she stayed with them from the age of 9 to 12 and Soghra’s age at the time of the alleged crime not to mention that they have already sent Soghra to be executed once.

Iranian girl who was sentenced to death since age of 13 is free after 18 years

According to Etemaad newspaper in Iran, Soghra Najafpour the Iranian girl who was sentenced to execution since the age of 13 was released today after 18 years.

Soghar was sentenced to death for alleged murder of a young child. Soghra had always denied the charges. She has spent all of her adult life , 18 years, in prison and is now 30 years old.  If not female, at the age of 12, Soghra would not have been sentenced to death, because according to Iran’s Islamic Sharia law a girl at 9 and a boy at 13 is considered an adult.

Stop Child Executions Campaign had reported Soghra’s anticipated release in May 2007.

Soghra was once taken to be executed but appealed last minute. Soghra’s family live in a small village in Northern Iran near Caspian Sea. She was being presented by Nasrin Sotoudeh who is also the attorney for Sina Paymard, another boy who is anticipated to be released soon. According to Ms. Sotoudeh, there are  “many more” children facing executions in smaller towns. “These have not been reported in the press nor do they appear in officials records” she said.

Soghra is a girl with long straight hair and frightened green eyes who was known by the volunteers at Rasht prison, a city in northern Iran near Caspian sea, as the longest kept prisoner. She who was hired at the age of 9 as a servant in a Doctor’s home, but 4 years later she was accused of murder of the 8 year old son of the family. At the time 13 year old Soghra confessed to murder but soon after she denied any involvement and blamed her older boyfriend for it. Death of an 8 year old boy by a mature man rather than by a small framed, slim 13 year old girl seemed more logical and deserved more investigation but judges had already sentenced her to death and therefore discounted her story claiming that such man never existed and did not believe Soghra who said the reason for her initial silence was because she used to be in love with him.

17 years later, she has lost her teeth, takes strong antidepressant medications, been under surgery a few times and her hand shakes at the age of 30. She talks about her childhood that how her poor parents in return for a sack of rice sent her to serve at the “Doctor’s” home and how at the age of 13 she was sentenced to death for the murder that she did not commit.

Soghra knows Delara Darabi, another prison mate who was sentenced to death at the age of 17. Unlike Soghra who did not have a chance to attend school, Delara has high school education and that is why she helped Soghra with filling out her legal paperwork. After all not only they were the only two children in that prison who were sentenced to death, but they both used to be in love with men who took advantage of their childhood innocence.

Nazanin Afshin-Jam and Stop Child Executions Campaign are very happy about the news of freedom of Soghar Najafpour and thank her attorney Mrs. Nasrin Sotoudeh and everyone who helped gain Soghra’s freedom. We also thank all the volunteers and supporters of Stop Child Executions Campaign for spreading Soghra’s story.

Looking forward to the day that no child in Iran and the world is given the execution verdict.

Lost Childhood – Sentenced to death at 13

Iran is a signatory to Convention on the Rights of the Child but its laws continue to remain in contraction with CRC. According to the laws of Iran, the penal age for girls is 9 and 15 for boys. A girl who does not even have the right to hold a bank account, suddenly in the eyes of Islamic Judges is treated like an adult at the age of 9. Soghra Najafpour who was sentenced to death at childhood is an example of this injustice:

With long straight hair and frightened green eyes, Soghra is known by the volunteers at Rasht prison as the longest kept prisoner.

That 13 year old child is now 30 years old waiting 17 years of her teenage years and twenties to be executed. Already once she was even taken to be executed but appealed last minute.

These days there is a small flicker of hope for Soghra: According to her attorney and children rights activist, Nasrin Sotoudeh, Soghra obtained a ruling for her release in return for approximately $40,000 bail but without any change in her execution verdict.

But Soghra’s family who live in a small village have no such financial capacity and therefore Soghra continues to live in the only home that she has known since the age of 13:  Rasht Prison of the Islamic Republic of Iran.

Girl sentenced to death since 13 , anticipated to be freed at age 29

Stop Child Executions Campaign was informed of yet another Iranian female who is sentenced to death for alleged murder of a 9 year old boy. Soghra was 13 years old at the time and has always denied the charges. She has spent all of her adult life , 17 years, in prison and is now 29 years old.

If not female, at the age of 13, Soghra would not have been sentenced to death, because according to Iran’s Islamic Sharia law a girl at 9 and a boy at 13 is considered an adult.

Soghra’s family live in a small village in Northern Iran near Caspian Sea. She is being presented by Nasrin Sotoudeh who is also the attorney for Sina Paymard, another boy who is facing imminent execution. According to Ms. Sotoudeh, there are  “many more” children facing executions in smaller towns. “These have not been reported in the press nor do they appear in officials records” she said.

Soghra is imprisoned in the same prison as Delara Darabi and Delara has been helping Soghra with some of her legal representation within prison which eventually resulted in posting a guarantee for her freedom. Soghra’s father has been able to secure the deed of a house as guarantee and therefore Soghra is expected to be freed after 17 years. Delara has been very happy that Soghra will be freed soon.
