Iranian judicial authorities considering Makwan Moloudzadeh’s appeal

Iranian judicial authorities are considering Makwan Moloudzadeh’s appeal against his death sentence.

On 14 November, a branch of the Supreme Court heard an appeal against the death sentence imposed on child offender Makwan Moloudzadeh. At some time during the next few months, the Supreme Court is expected to rule on whether the sentence passed on Makwan Moloudzadeh remains valid.

Makwan Moloudzadeh, an Iranian Kurd, was convicted of lavat-e iqabi (anal sex) for alleged rape about eight years ago, when Makwan Moloudzadeh was aged 13. Amnesty International has recently received new information that he allegedly raped three individuals. Under Iranian law, boys under 14 years and seven months (15 lunar years) and those who have not reached puberty are considered children. Article 113 of Iran’s Penal Code states, “If a minor has anal sex with another minor, each will receive up to 74 lashes unless one of them was forced to do so [in which case he will not be punished].”

Following his arrest on 1 October 2006 in Paveh, western Iran, Makwan Moloudzadeh was tried and on 7 July 2007 found guilty and sentenced to death by Branch 1 of the Kermanshah Criminal Court, in an unfair trial. The plaintiffs reportedly withdrew their complaints in the course of the trial and at least one was reportedly arrested in order to make him appear in court. During his trial, Makwan Moloudzadeh is said to have maintained his innocence. Previously, however, he claimed he was ill-treated during interrogation and “confessed” during interrogation that he had had a sexual relationship with a boy in 1999.

According to Article 49 of Iran’s Penal Code: “Children, if committing an offence, are exempted from criminal responsibility. Their correction is the responsibility of their guardians or, if the court decides, by a centre for correction of minors.”

Makwan Moloudzadeh lodged an appeal on 5 July, which the Supreme Court rejected on 1 August. In finding Makwan Moloudzadeh guilty, judges relied on ‘elm-e qazi - the “knowledge of the judge” - to determine that penetration had taken place and that Makwan Moloudzadeh had reached puberty at the time of his alleged offence and could thus be sentenced to death as an adult.

BACKGROUND INFORMATION

International law strictly prohibits the use of the death penalty against people convicted of crimes committed when they were under the age of 18. The Committee on the Rights of the Child has raised concern about child offenders’ criminal responsibility being determined by judges, using subjective and arbitrary criteria such as the attainment of puberty, the age of discernment or the personality of the child. As a state party to the International Covenant on Civil and Political Rights and the Convention on the Rights of the Child, Iran has undertaken not to execute child offenders. However, since 1990, Iran has reportedly executed at least 27 child offenders, five of them in 2007. Most recently, Mohammad Reza Turk was executed on 15 November 2007 after conviction of murder. At least 75 child offenders are on death row in Iran; and there are fears that at least 15 Afghan child offenders convicted of drug smuggling may have been, or face being, sentenced to death. RECOMMENDED ACTION: Using your own words, please choose a few of the suggestions below to create a personal appeal and send it as quickly as possible:

- welcoming reports that a committee of the Supreme Court is re-considering the case against Makwan Moloudzadeh;
- noting that his original trial was unfair, as the judge is said to have relied on subjective and arbitrary criteria in contravention to the Convention on the Rights of the Child and that the appeal appears to have ignored the retraction of testimony made by witnesses;
- reminding the authorities that Iran is a state party to the International Covenant on Civil and Political Rights and the Convention on the Rights of the Child, which prohibit the use of the death penalty against people convicted of crimes committed when they were under 18, so executing Makwan Moloudzadeh would be a violation of international law;
- urging the authorities to abolish the death penalty for offences committed by anyone under the age of 18, so as to bring Iran’s domestic law into line with its obligations under international law.

URGENT ACTION: Help save Makwan Moludzadeh

A newspaper reporter who has been in contact with Makwan’s father told Human Rights Watch that the place of execution of Makwan is now determined by Iranian Authorities and Makwan can be executed anytime.

Makwan was sentenced to death in May by a court ruling on questionable evidence for a crime supposedly committed when he was a 13-year-old child. The court handed down the conviction despite retractions on the part of his accusers during the trial and various apparent violations of Iran’s criminal procedure law.

Dubious Conviction Based on Recanted Testimony Requires Re-Trial

(Washington, DC, November 3, 2007) – Iranian authorities should immediately prevent the execution of Makwan Mouloudzadeh and commute his death sentence, Human Rights Watch Organization said today. Mouloudzadeh, 20, was sentenced to death in May by a court ruling on questionable evidence for a crime supposedly committed when he was a 13-year-old child.

On May 25, Branch Seven of the Penal Court of the city of Kermanshah sentenced Makwan Mouloudzadeh to death on charges of raping three boys as a 13-year-old. The court handed down the conviction despite retractions on the part of his accusers during the trial and various apparent violations of Iran’s criminal procedure law.  
 
“Makwan Mouloudzadeh faces death for crimes supposedly committed as a 13-year-old, which even his accusers admit never occurred,” said Joe Stork, deputy Middle East director at Human Rights Watch. “Ayatollah Shahrudi, the head of the Judiciary, needs to act now to ensure that his death sentence is revoked and Mouloudzadeh gets a new trial.”  
 
A journalist in Iran who has followed the case and spoken to Mouloudzadeh’s father told Human Rights Watch that the authorities have determined the place where Mouloudzadeh is to be hanged in public, indicating that his execution may be imminent.  
 


In September 2006, three men complained to police in the northwestern town of Paveh that Mouloudzadeh had raped them seven years earlier. The police arrested Mouloudzadeh, and then humiliated him by shaving his head, placing him on a donkey, and parading him around the town.  
 
Iranian laws regarding “crimes of chastity” such as rape require that the office of the public prosecutor send the case for complete investigation to the penal court, where the judge may question the accusers and arrange for examination by a physician.  
 
Saeed Eghbali, Mouloudzadeh’s lawyer, told the Iranian press that the office of the public prosecutor defied these laws, carried out investigations on its own, and took the case to court, where the judge refused to accept the accusers’ retractions.  
 
During court proceedings, Mouloudzadeh claimed that all confessions he had made about the alleged crimes were false and coerced. The judge also refused to accept Mouloudzadeh’s statements about being forced to admit to crimes he had not committed and did not dismiss the case.  
 
Under Iranian law, “crimes of chastity” such as rape are sent directly to the country’s Supreme Court for final review. On July 19, Iran’s Supreme Court approved the death sentence, which may be carried out at any time.  
 
Background  
 
Iran leads the world in executing juvenile offenders – persons under 18 at the time of the crime – and is known to have executed two juvenile offenders already this year. Syed Mohammad Reza Mousavi Shirazi, 20, was executed in Adel Abd prison in the city of Shiraz on April 22, 2007 for a murder he was found to have committed when he was 16. Sa`id Qanbar Zahi was executed in Zahedan on May 27, 2007 for a crime he was found to have committed when he was 17.  
 
Human Rights Watch opposes capital punishment in all circumstances because of its cruel and inhumane nature. In particular, in imposing sentences of death on people for crimes committed before the age of 18, Iran flouts clear and specific human rights obligations. The International Covenant on Civil and Political Rights and the Convention on the Rights of the Child, both of which Iran has ratified, bar the imposition of the death penalty for such offenses. These provisions reflect the reality that children are different from adults. They lack the experience, judgment, maturity, and restraint of an adult.  
 
Iranian officials claim that legislation pending in parliament since July 2006 would end executions of juvenile offenders. In fact, the legislation would only offer the possibility of reduced sentences in a small minority of cases.

ديده بان حقوق بشر: نوجوان کرمانشاهی را اعدام نکنید


(واشنگتن سوم آبان ماه 1386)  سازمان دیده بان حقوق بشر اظهار داشت که مقامات مسئول ایرانی باید هر چه سریعتر از اعدام مکوان مولود زاده جلوگیری کنند و حکم مرگ وی را تغییر دهند.

مولود زاده بیست ساله توسط دادگاهی بر اساس مستندات شائبه دار و مخدوش در خرداد ماه سال جاری محکوم به اعدام شد در حالی که وی در هنگام ارتکاب جرم، کودکی 13 ساله بود.
 

شعبه هفت دادگاه جنایی شهرستان کرمانشاه، مکوان مولود زاده را به اتهام تجاوز به سه کودک در سن 13 سالگی در چهارم خرداد ماه سال جاری به مجازات مرگ محکوم کرد. این دادگاه در حالی بر محکومیت فوق اصرار داشت که بخشی از شاکیان اتهام های شان را پس گرفتند و همچنین در روند دادرسی،به نظر میرسد که تخلفات متعدد از آئین دادرسی جزایی ایران صورت گرفت.  
 

جو استورک معاون مدیر بخش خاور میانه سازمان دیده بان حقوق بشر گفت:” مکوان مولود زاده در حالی با حکم مرگ روبه رو می شود که در هنگام ارتکاب جرم 13 سال داشته است که حتی مدعیانش پذیرفتند که آن جرائم رخ نداده اند.آیت الله شاهرودی رئیس قوه قضائیه شایسته است تا اقدامی انجام دهد تا اطمینان حاصل شود که حکم اعدام لغو شده است و پرونده مولود زاده مجددا مورد دادرسی قرار گیرد.”  

یک روزنامه نگار که پرونده مولود زاده را پیگیری کرده و با پدر وی نیز صحبت کرده است به سازمان دیده بان حقوق بشر گفت که متصدیان مربوطه از همین الان محلی را که قرار است مولود زاده در آنجا در ملا عام به طناب دار آویزان شود، مشخص کرده اند و این امر گمانه ای است که ممکن است زمان اعدام وی نزدیک باشد.  

 

سه مرد در شهریور ماه 1385 به یک پاسگاه پلیس در شهر پاوه مراجعه نموده و شکایت کردند که مولود زاده هفت سال پیش به آنها تجاوز کرده است.پلیس وی را دستگیر کرد و سپس او را با زدن مو های سرش ،نشاندن بر روی خر و گرداندن در دور شهر تحقیر کرد.  
 

قوانین ایرانی مربوط به جرائم عفت عمومی از قبیل تجاوز اشعار می دارد که دادستانی دادگاه عمومی باید پرونده را برای تحقیقات بیشتر به دادگاه جزائی بفرستد، جایی که قاضی ممکن است از شاکیان سئوال کند و ترتیبی دهد تا توسط یک پزشک قانونی معاینه گردند.  
 

سعید اقبالی وکیل مولود زاده به روزنامه های ایرانی گفت که دادستانی دادگاه عمومی قوانین مربوطه را نقض کرد . تحقیقات را خودش انجام داد و پرونده را به دادگاه فرستاد و دادگاه نیز از پذیرش انصراف شاکیان امتناع کرد.  
 

مولود زاده در جریان دادرسی ادعا کرد که تمامی اعترافاتی که او درباره جرائم مربوطه کرده بود نادرست بوده و تحت فشار از وی اخذ شده است. قاضی همچنین از پذیرش ادعای مولود زاده مبنی بر اینکه مجبور شده است تا اتهاماتی را بپذیرد که مرتکب نشده بود، سرباز زد و پرونده را مختومه نکرد.  
 

بر اساس قوانین ایرانی جرائم مربوط به عفت عمومی نظیر تجاوز مستقیما برای تجدید نظر خواهی نهایی به دیوان عالی کشور ارسال می شود. دیوان عالی کشور در 28 تیرماه امسال مجازات مرگ را تایید کرد که ممکن است هر لحظه اجرا شود.  
 
زمینه  
 

ایران مقام اول دنیا در اعدام مجرمان جوان را دارد یعنی متهمانی که در هنگام ارتکاب جرم، سن شان زیر 18 سال بوده است.  
 

همچنین مشخص شده است که ایران دو نوجوان را در همین سال اعدام کرده است. یکی از آنها محمد رضا موسوی شیرازی بیست ساله بود که در زندان عادل آباد شهرستان شیراز در تاریخ 4/02/1386 اعدام شد. دلیل اعدام وی دخالت در قتلی بود که در 16 سالگی انجام شده بود. دیگری سعید قنبر زهی بود که در تاریخ 6/03/1386 در شهرستان زاهدان اعدام شد. وی وقتی 17 سال داشت در جرمی مشارکت کرده بود.  
 

سازمان دیده بان حقوق بشر با مجازات اعدام در تمامی حوزه ها به دلیل ماهیت غیر انسانی و نا عادلانه آن مخالف است.بویژه تحمیل مجازات مرگ برای کسانی که در هنگام وقوع جرم ، سن شان زیر 18 سال بوده است. حکومت ایران به نحو بارز و صریحی ، الزامات حقوق بشری را زیر پا گذاشته است. معاهده حقوق مدنی و سیاسی و همچنین کنوانسیون حقوق کودک که هر دوی آنها توسط حکومت ایران امضا شده اند، صدور حکم اعدام برای مجرمانی که سن شان پایین تر از 18 سال است، را ممنوع کرده اند.این قوانین در اصل این واقعیت را منعکس می کنند که کودکان از بزرگسالان متفاوت هستند.آنها تجربه، قضاوت،بلوغ و خود کنترلی بزرگسالان را ندارند.  
 

مقامات ایرانی مدعی هستند قوانینی که از مرداد 1385 در پارلمان در انتظار تصویب هستند، به اعدام نوجوانان پایان خواهند داد. در حقیقت، این قوانین فقط امکان تقلیل احکام در موارد محدودی را پیشنهاد می دهند.

جوان 20 ساله در انتظار اعدام

جوان 20 ساله‌اي كه متهم است در سن 13 سالگي مرتكب تجاوز به عنف شده است در انتظار اعدام به سر مي‌برد.

اين در حالي است كه شاكيان اين پرونده پس از برگزاري جلسه محاكمه اعلا‌م كرده‌اند كه اظهاراتشان با واقعيت منطبق نبوده و هرگز متهم جوان پرونده چنين عملي را انجام نداده است.

شاكيان حتي حاضر شده‌اند داوطلبانه به پزشكي قانوني رفته و مورد معاينه قرار گيرند، در صورتي كه در هيچكدام از مراحل تحقيق پرونده شاكيان به پزشكي قانوني معرفي نشده بودند.

متهم اين پرونده، جواني ساكن يكي از شهرهاي غرب كشور است كه در حال حاضر با حكم قضات شعبه هفتم دادگاه كيفري كرمانشاه به اعدام محكوم شده است.

<ماكوان> مهرماه سال گذشته از سوي ماموران اداره آگاهي پاوه در حالي كه در باغ پشت خانه‌شان در حال كشيدن سيگار بود، دستگير شد.

در آن زمان جوان 20 ساله و خانواده‌اش گمان مي‌كردند از آنجا كه پسرشان در ماه رمضان و در ملاءعام مشغول كشيدن سيگار بود، دستگير شده است اما با بازداشت طولا‌ني‌مدت ماكوان و اتفاقاتي كه پس از آن براي او رخ داد ماجرا به صورت ديگري رقم خورد.

تنها چند روز پس از آنكه ماكوان دستگير شد، خانواده‌اش در شهر پاوه مطلع شدند كه پسرشان را سوار بر الا‌غ كرده‌اند در شهر مي‌چرخانند. هيچكس با انجام چنين كاري به درستي نمي‌دانست كه اتهام ماكوان 20 ساله چه بوده كه بايد با آن وضع سوار الا‌غي شده و در شهر چرخانده مي‌شد.

پدر ماكوان مي‌گويد: در آن روز ماكوان را ديدم كه او را سوار بر الا‌غ مي‌كردند تا همه او را ببينند. مردم از ما مي‌پرسيدند ماكوان را به چه اتهامي سوار بر الا‌غ كردند اما ما نمي‌دانستيم كه بايد چه جوابي به آنها بدهيم. ماكوان جرمي نداشت كه سزاوار چنين توهين‌هايي باشد.>

اين ماجرا گذشت تا اينكه خانواده ماكوان متوجه شدند چند جواني به دادسرا احضار شده‌اند و عليه پسرشان شكايت كرده‌اند.

با پيگيري‌هاي خانواده او مشخص مي‌شود اين چند جوان مدعي شده‌اند در 13 سالگي ماكوان آنها را مورد تعرض قرار داده است و از آنها خواسته تا با كسي در اين مورد صحبت نكنند.

اين مساله در حالي بود كه دادسرا با وجود آنكه با يك پرونده منافي عفت روبه‌رو بود و موظف بود كه بدون هيچ مداخله و تحقيقي پرونده را مستقيما به دادگاه بفرستد در اين باره دست به تحقيقات گسترده ديگري نيز زد و در نهايت جوان 20 ساله را همراه پرونده تشكيل شده به دادگاه كرمانشاه فرستاد. ‌

به گفته سعيد اقبالي، وكيل‌مدافع اين پرونده، در جلسه محاكمه اين جوان 20‌ساله كه طبق قانون و شرع مي‌بايست به طور كامل و دقيق با بررسي و احراز عمل تجاوز تشكيل مي‌شد، حتي بدون فرستادن شاكيان به پزشكي قانوني، قضات به صدور راي پرداختند.

در اين جلسه علي‌رغم عدم حضور برخي از شاكيان و حضور تنها سه نفر از آنها كه آنها نيز چندين مرتبه اعلا‌م كردند كه اظهارات گذشته‌شان دروغ بوده و چنين عملي با آنها انجام نشده است، قضات دادگاه با استناد به علم قاضي آن‌هم علم به وجود ايقاب (دخول كامل) نسبت به صدور حكم اعدام اقدام كردند.

وكيل‌مدافع ماكوان پس از صدور حكم دادگاه و با انتقاد به اين مساله مي‌گويد: <دادگاه در احراز ركن مادي يعني همان انجام عمل موجب حد قتل هيچ تحقيقي نمي‌كند در حالي كه به استناد ماده 108 قانون مجازات اسلا‌مي عمل شنيع لواط شامل دو مفهوم است كه تنها لواط ايقابي چنين مجازاتي را در پي خواهد داشت و دادگاه به اين تكليف قانوني خود عمل نكرده است.

از سوي ديگر دادگاه استدلا‌ل كرده كه چون چندين سال از زمان انجام عمل مي‌گذرد و موضوع از سوي پزشكي قانوني قابل تشخيص نيست و شكات را جهت معاينه معرفي نكرده يعني پذيرفته كه عمل در زمان طفوليت انجام شده اما در جايي ديگر براي قانوني نشان دادن حكم اعدام استدلا‌ل كرد كه انجام عمل تا زمان حال ادامه داشته است اما مبنايي براي علم خود در اين خصوص نمي‌آورد.>

حكم اعدام ماكوان 20‌ساله صادر شده است و با تعاريف وكيل‌مدافع وي، خانواده‌اش و حتي شاكيان او مرتكب چنين عملي نشده كه مستحق چنين حكمي باشد.

پدر ماكوان كه پس از صدور حكم چند بار به تهران آمده تا نزد رئيس قوه قضاييه برود بلكه مشكل پسرش را گفته و از اجراي حكم او جلوگيري كند، مي‌گويد: <در پاوه افرادي به همين اتهام دستگير شدند، اين مساله در مورد آنها ثابت شده اما بازهم برايشان حكم اعدام صادر نكردند. پسر من چندين مرتبه سابقه درگيري داشت و هر بار هم چند روزي در بازداشت بود اما اين كار از او برنمي‌آيد. اگر واقعا او اين كار را كرده بود، خودم طناب دار را بر گردنش مي‌انداختم. كاش همان بار اول كه به اتهام شركت در درگيري بازداشت شده بود او را به زندان مي‌فرستادند تا سرش به سنگ بخورد اما من بچه‌ام را مي‌شناسم او نمي‌تواند اين كار را كرده باشد. از آن گذشته چيزي ثابت نشده كه براي او حكم اعدام صادر كردند. همه شاكياني كه در مرحله اول هم اعلا‌م شكايت كرده بودند پس از آن گفته‌اند كه دروغ گفته‌اند. آنها در همان دوران بچگي يك كدورت‌هايي با هم داشتند؛ اين مساله نمي‌تواند باعث شود بچه‌ام را اعدام كنند

Amnesty International today warned us of yet another child due to be executed in Iran for alleged rape of a  boy. Both boys were 13 years old at the time.

IRAN Makwan Moloudzadeh (m), aged 21, child offender                 

Child offender Makwan Moloudzadeh, an Iranian Kurd, is believed to be at risk of imminent execution. He has reportedly been convicted of lavat-e iqabi (anal sex) for the alleged rape of a 13-year-old boy. Makwan Moloudzadeh was aged 13 at the time of the alleged offence. His death sentence has been passed to the Office for the Implementation of Sentences and he is due to be executed in public, near his home.

He was reportedly arrested on 1 October 2006 in Paveh, in the western province of Kermanshah . He was detained in Paveh Prison and later transferred to Kermanshah Central Prison. Following interrogations in Paveh during which he was reportedly ill-treated, he was tried by Branch 1 of the Kermanshah Criminal Court and on 7 June 2007 he was sentenced to death. The witnesses and the two people who had pressed charges against him withdrew their claims after the trial. Under Iranian law, children (boys of up to 14.7 years) are to be flogged for lavat (“homosexual acts”).


However, the judge relied on ‘elm-e qazi, the “knowledge of the judge” to determine that penetration had taken place and that Makwan Moloudzadeh could be sentenced to death. Makwan Moloudzadeh lodged an appeal on 5 July, which the Supreme Court rejected on 1 August. Several witnesses have withdrawn their testimonies and signed notarized written statements to that effect.
During his trial, Makwan Moloudzadeh reportedly maintained his innocence. Previously, however, he was reportedly ill-treated during interrogation and “confessed” during interrogation that he had had a sexual relationship with a boy in 1999. He is reported to have gone on hunger strike for 10 days to protest against his ill-treatment in detention. Following his trial and conviction, on or around 7 October 2006 Makwan Moloudzadeh was reportedly paraded through the streets of Paveh riding on a donkey, with his head shaved. People in the street shouted abuse and threw things at him.

Article 1210(1) of Iran ’s Civil Code sets the ages of 15 lunar years as the age of criminal responsibility for boys, and nine lunar years for girls. Makwan Moloudzadeh was reportedly born on 31 March 1986 and, at the age of 13, was a minor under Iranian law at the time of the alleged offence. According to Article 49 of Iran’s Penal Code: “Children, if committing an offence, are exempted from criminal responsibility. Their correction is the responsibility of their guardians or, if the court decides, by a centre for correction of minors.”

Furthermore, in this case the judge used the customary practice of “judge’s knowledge” to override Article 113 of Iran’s Penal Code which states, “If a minor has anal sex with another minor, each will receive up to 74 lashes unless one of them was forced to do so [in which case he will not be punished].”


BACKGROUND INFORMATION

International law strictly prohibits the use of the death penalty against people convicted of crimes committed when they were under the age of 18. The Committee on the Rights of the Child has raised concern about child offenders’ criminal responsibility being determined by judges, using subjective and arbitrary criteria such as the attainment of puberty, the age of discernment or the personality of the child. As a state party to the International Covenant on Civil and Political Rights and the Convention on the Rights of the Child, Iran has undertaken not to execute child offenders. However, since 1990, Iran has executed at least 24 child offenders, with a further two reportedly put to death on 17 October 2007. At least 78 child offenders are on death row in Iran ; at least 15 Afghan child offenders are reportedly under sentence of death. RECOMMENDED ACTION: Please send appeals to arrive as quickly as possible, in Persian, Arabic, English or your own language:
- calling on the Head of the Judiciary to urge the Supreme Court to review the case of Makwan Moloudzadeh who was a child at the time of his alleged offence under Iran’s Civil and Penal Codes;
- expressing concern that Makwan Moloudzadeh may have faced an unfair trial in which a judge relied on subjective and arbitrary criteria in contravention to the Convention on the Rights of the Child and that the appeal appears to have ignored the retraction of testimony made by witnesses;
- expressing concern that Makwan Moloudzadeh is at risk of execution for a crime committed when he was under 18, and calling on the authorities to halt his execution immediately and commute his death sentence;
- reminding the authorities that Iran is a state party to the International Covenant on Civil and Political Rights and the Convention on the Rights of the Child, which prohibit the use of the death penalty against people convicted of crimes committed when they were under 18, so executing Makwan Moloudzadeh would be a violation of international law;
- urging the authorities to abolish the death penalty for offences committed by anyone under the age of 18, so as to bring Iran’s domestic law into line with its obligations under international law;
- stating that Amnesty International acknowledges the right and responsibility of governments to bring to justice those suspected of criminal offences, but opposes the death penalty unconditionally.
