Correction

Please note that the 2 billion Rials blood money retribution requested for Reza Alinejad converts to more than $200,000 dollars and not as originally reported as 2 million dollars.

Reza Alinejad asked to pay 200,000 dollars or face execution

Following last month's order of Iran's head of judiciary, Ayatollah Shahrudi, to have the case of Reza Alinejad resolved through the mediation council, the family of the victim demanded 2 billion Rials (more than 200,000 dollars) blood money retribution. Alinejad's family not being able to afford such demand , the file was sent back to office of Ayatollah Shahrudi for final approval of execution decree.
Meanwhile Mohammad Mostafaei , Reza's attorney told ISNA (Iranian Student News Agency) that Iran's supreme court has agreed to review the case based on the evidences presented by Mostafaei.

Mostafaei's bid to enter Iran's parliament was denied

In an effort to effect a change in the penal laws of Iran to meet the international standards of human rights and justice such as those laws effecting children, the Iranian human rights lawyer, Mohammad Mostafaei registered for the upcoming parliamentary elections in Iran.  However as anticipated, his application was denied by the  authorities of the Islamic regime in Iran.

Mr. Mostafaei represents many other Iranian youth facing executions and he has been a proponent of overhaul of Iran's penal codes in matters such as women and children's rights. He also co-defended the case of Nazanin Fatehi who was eventually found to be innocent and release. In a
letter to Iran's parliament last year , he asked for a speedy approval of the parliamentary bill effecting juveniles which has been stalled for the past four years. He also wrote another letter asking Ayatollah Shahrudi , the head of Iran's judiciary to halt child executions until the passage of this juvenile bill in parliament be accessed. None of his letters were responded to. Mostafaei's effort to enter Iran's parliament was another attempt by him to help those who are facing injustice in Iran including his clients who are facing imminent executions.

More than half of the reformist candidates have reportedly been disqualified throughout Iran by the conservative interior ministry. The reason for denials was explained to be due to applicants' "Lack of commitment to Islam in practice" . In 2004 the authorities banned more than 2,000 out of 8,172 candidates who registered, many of them reformists, leading the way for a victory by the conservatives. Even after the controlled election process, all approved parliamentary bills are also subject to approval of Islamic a pre-selected Islamic Guardian Council. Iran's supreme leader Ayatollah Khamenei (another non-elected position) is the ultimate authority and maintains the final say in all matters.

According to the constitution of the Islamic regime in Iran, the candidates for parliamentary and presidential elections must be pre-selected by the Islamic authorities . This allows Iran's regime to  authorize only Islamic fundamentalists to enter the parliamentary and presidential races. Such pre-selection processes of candidates is in violation of international and democratic election standards.

تقاضاي دادرسي رضا علی نژاد در ديوان عالي پذيرفته شد

محمد مصطفايي : موكلم توان پرداخت ديه 2 ميليارد ريالي در خواستي اولياي دم را ندارد . تقاضاي موكلم مبني براعاده دادرسي در ديوان عالي كشور پذيرفته شد

محکوم به قصاص با پذيرفته شدن درخواست اعاده دادرسي در ديوان عالي کشور، فرصتي دوباره يافت
محمد مصطفايي در اين باره اظهار داشت؛ طبق محتويات پرونده «رضا» 17 ساله متهم به مباشرت در قتل عمدي «اسماعيل» با وارد کردن ضربه چاقو به گردن وي است. وي با بيان اينکه قتل در 15 دي ماه سال 81 در شهرستان فسا به وقوع پيوست، گفت؛ طبق محتويات پرونده رضا به همراه دوستانش روز حادثه در خيابان فيروزآبادي شهرستان فسا ايستاده بودند که سه نفر از جمله مقتول به طرف آنها مي آيند و در اين ميان بين آنها درگيري جزيي پيش مي آيد و اسماعيل با نانچيکو چند ضربه به رضا وارد مي کند که وي در اثر اين ضربات از ناحيه سر مصدوم مي شود و براي دفاع چاقويش را درمي آورد و ناگهان ضربه يي به گردن مقتول وارد مي کند که اسماعيل در اثر شدت جراحت وارده در بيمارستان فوت مي شود. مصطفايي افزود؛ دادگاه پس از محاکمه حکم قصاص رضا را صادر کرد اما قضات شعبه 16 ديوان عالي کشور اين حکم را با پذيرش امکان دفاع مشروع نقض کردند و پرونده را براي رسيدگي مجدد به شعبه ششم دادگاه فسا ارجاع دادند که اين شعبه نيز حکم به قصاص متهم داد. وي گفت؛ بعد از صدور مجدد حکم قصاص رضا نسبت به راي صادره از شعبه ششم دادگاه فسا اعتراض کردم و پرونده به هيات عمومي ديوان عالي کشور ارجاع و اين هيات در راي اصراري حکم قصاص متهم را صادر کرد و پرونده به شعبه اجراي احکام ارسال شد. وکيل اين محکوم به قصاص افزود؛ در ادامه پرونده به تهران ارسال شد و رئيس قوه قضائيه آن را براي انجام صلح و سازش به شوراي حل اختلاف ارجاع داد.
 
وي با بيان اينکه اولياي دم در جلسه شوراي حل اختلاف با حضور دادستان فعلي فسا و رئيس شوراي حل اختلاف و تني چند از معتمدان محلي در ازاي اعلام رضايت، تقاضاي دو ميليارد ريال ديه کردند، گفت؛ موکلم توان پرداخت اين ميزان از ديه را نداشت و به همين خاطر بدون جلب رضايت اولياي دم، پرونده به دفتر رئيس قوه قضائيه براي استيذان ارسال شد. مصطفايي افزود؛ با توجه به اخذ دلايل جديد مبني بر تاييد دفاع مشروع در اين پرونده، اعاده دادرسي را تقاضا کرديم و موضوع در ديوان عالي کشور مطرح شد و پرونده را از دادگاه فسا خواستند. وي ابراز عقيده کرد؛ با توجه به پذيرش اعاده دادرسي از سوي ديوان عالي کشور بايد مجدداً پرونده مورد بررسي قرارگيرد.

EU condemns Iran for the surge of child execution orders

Following the urgent action reports by Stop Child Executions, Amnesty International and international committee against executions, the European Union and its candidate countries (42 states) issued a condemnation of Iran's ruling regime for its new surge of juvenile execution orders. Stop Child Executions Campaign thank the president of European Union and its members and candidates for this responsible and humanitarian action and encourage United Nations and all countries of the world to also condemn violation of the International Covenant on Civil and Political Rights and the Convention on the Rights of the Child by the Islamic regime in Iran.

Declaration by the Presidency on behalf of the EU concerning death sentences in Iran

The EU is deeply concerned by the news of the imminent execution of Ali Mahin Torabi, Saeed Jazee, Amir Amrolahi, Rahim Ahmadi, Mohammadreza Haddadi, Behnood and Ali (identified only by his name), who were convicted and sentenced to death for crimes committed when they were minors.

The EU notes that these executions are a direct contravention of the Islamic Republic of Iran’s international commitments, specifically the International Covenant on Civil and Political Rights and the Convention on the Rights of the Child, both clearly prohibiting the execution of minors or people who have been convicted of crimes committed when they were minors.

Etemaad's report of Ali's scheduled execution is NOT accurate

Yesterday, Iran's Etemaad daily newspaper reported that Ali Mahin-Torabi is to be executed in 15 days.
The news was also reported in the weblog of the Etemaad reporter , Marjan Laghaee .

This morning Stop Child Executions Campaign was able to talk to Ali's mother and we have verified that report is inaccurate and Ali's execution order has not been issued. Although Ali was told by prison officials that some prisoners may be executed after the Shia holy month of Moharam , but no specific official notice of Ali's execution has been issued and therefore he is not expected to be in the list.

We remain hopeful that the new development and the witness testimony would help save Ali from execution. Ali's attorney Mohammad Mostafei is in city of Shiraz handling the case of three other juveniles facing execution and upon return will look in to this matter further.

SCE Campaign will continue to report the news from Iran with reference to the sources as we received them, however we will not confirm their validity until it is independently verified.

سرنوشت بزهکاران ناخواسته

 محمد جعفر ساعد- دانشجوی دوره دکتری جزا و جرم شناسی ، کارآموز وکالت  

اصل خبر : حکم اعدام جوان 20 ساله ای که در جریان درگیری در سن 16 سالگی موجبات مرگ همکلاسی خود را در مدرسه فراهم آورده بود ، در اجرای احکام است
موضوع از چه قرار است ؟ به روایت لایحه وکیل مدافع علی ، او که برای میانجیگری وارد معرکه ای شده ، چاقویی را فقط برای ترساندن مزدک نشان می دهد اما در این میان ، به واسطه هل دادن تعدادی از بچه های مدرسه ، مزدک مجروح می شود و سپس فوت می کند. علی هم به عنوان متهم به قتل مزدک به موجب بند "ب" ماده 206 محکوم به قصاص می شود و با قطعی شدن رای ، ضمن در خواست وکیل وی از ریاست قوه قضاییه ، جوان ناکام اکنون در انتظار اجرای حکم ، آخرین نفس هایش را در این دنیای وانفسا تجربه می کند.
تحلیل موضوع: صرف نظر از وقوع جرم در دوران 16 سالگی وایراد وارد بر تحمیل مسوولیت کیفری بر اشخاص در این مقطع سنی و قطع نظر از عدم رعایت تشریفات قانونی نظیر عدم بازسازی صحنه قتل و تنویز زوایای ضربه وارده بر سینه مقتول ، آنچه مسلم است اینکه علی در این حادثه صرقا چاقو را به نشانه ترس بازکرده و به دنبال آن وقوع جراحت به واسطه هل دادن بچه های پیرامون وی بوده است و به موجب همان بند استنادی دادگاه محترم ، تنها زمانی واقعه اتفاقی مشمول این بند می شود که " کاری " از سوی مرتکب صورت گرفته باشد و اتفاقا "کار" مزبور در ادبیات حقوق کیفری و در این مورد باید به شکل " مثبت " تبلور یابد . از این رو ، به رغم نشان دادن چاقو ، وقوع حادثه به واسطه جراحت ناشی از چاقو بوده که علی به هیچ روی در آن نقشی نداشته است . توسل به واژگان خشک و بی انعطاف حقوق کیفری در مواردی که یک کودک یا نوجوان به ناگاه و ناخواسته در منجلاب بزهکاری و به ویژه قتل گرفتار می شود، جز افزودن خاتمه حیات جوانی دیگر در کنار جوان متوفی، هیچ منفعتی برای جامعه و خانواده مقتول به بار نخواهد آورد ، جز اینکه دردی به خانواده ای دیگر تحمیل کند.
تکلمه : با اینکه تردیدی در دلخراش و غیر قانونی بودن رخدادهای جنایی به ویژه قتل ، برای ما و شما وجود ندارد، اما نوع اتفاق و نحوه ارتکاب با عنایت به شخصیت کودک یا نوجوان مرتکب یا حتی حرفه ای یا اتفاقی و احساسی بودن مرتکب ، خود به نوعی گویای صحت و سقم همان مقاصدی است که همواره با عنوان ادبیات خشک و سخت بودن حقوق کیفری بر ان سخن می رانیم . حال ، آیا بهتر نیست که با تفسیر منطقی به وقایعی اینچنین ، از حیات کودکان و جوانان " ناخواسته بزهکار" حمایت کنیم ؟

New hopes for Ali Mahin-Torabi

 

There has been a postive development in the case of Ali Mahin-Torabi the young boy facing execution for the death of his school mate Mazdak at the age of 16 and there is a possibly that he could even be found innocent of the charges.

Etemaad newspaper detailed the testimony of the Vice Principle of the school who gave insight about the incidents leading up to an argument between classmates that ended in the death of Mazdak. He testified that Ali Mahin is not a murderer. He said he believed that a fight ensued when Mazdak was late for school on that particular day therefore Ali Mahin and his friend who were assigned to ensure security of the school yard that day enacted their responsibility and brought him to the Principles office. Mazdak and Ali Mahin's friend had an argument over the matter.  When school was finished for the day, another fight broke out and the Vice Principle saw students pushing each other and some fell on the ground. He said he then noticed Mazdak was bleeding and Ali Mahin kept urging for someone to get him to a hospital. When the principle asked who did it, he believes Ali Mahin answered in haste that he had done it in order not to waste any time and to ensure Mazdak was sent to the hospital without any further delay. The Vice Principle believes that no one intended to commit murder that day, rather he believes it was an accident that occurred in the scuffle.

The Vice Principle's testimony has not officially been placed in the file, however if further investigation is carried out, this testimony could shift the outcome for better.


Etemaad also had reported that Ali was scheduled to be executed in 15 days. ابلاغ اعدام علي مهين ترابي در 15 روز

 علي مهين ترابي که به خاطر قتل در 15 سالگي به قصاص محکوم شد، در حالي واپسين روزهاي زندگي اش را در زندان سپري مي کند که اظهارات جديد ناظم مدرسه او بر بي گناهي اين جوان صحه مي گذارد.
به گزارش خبرنگار ما علي مهين ترابي که متهم است يکي از هم مدرسه يي هاي خودش به نام مزدک را در 15 سالگي در جريان يک نزاع مقابل دبيرستان به قتل رسانده اکنون روزهاي پراضطرابي را در زندان مي گذراند و تلاش براي نجات وي از پاي چوبه دار هنوز به نتيجه نرسيده است.اين در حالي است که وکيل مدافع علي پيش از اين از وجود ايراداتي در اين پرونده خبر داده و اعلام کرده بود اين ايرادها مورد تاييد رئيس قوه قضائيه هم قرار گرفته است اما تاکنون مشخص نشده اين ايرادات چيست و موضوع هنوز به وکيل وي گزارش نشده است.

پدر علي مهين ترابي ديروز به خبرنگار ما گفت؛ در تماسي که با دايره اجراي احکام دادگستري کرج داشتم به من اعلام کردند هنوز پرونده به اجراي احکام نرسيده است. در همين حال علي مهين ترابي روز گذشته در حالي که اضطراب در صدايش موج مي زد در تماس با مددکارش خبر داد، قرار است تا 15 روز ديگر او را اعدام کنند و در زندان اين مساله را به او ابلاغ کرده اند.

در حالي که افت و خيزها در پرونده اين جوان محکوم به مرگ همچنان ادامه دارد شاهدي در پرونده او پيدا شده که مدعي است در صحنه قتل حضور داشته و هرگز نديده که علي چاقو را بر شکم مزدک فرو کند.
