You are in our minds Delara

Last week human rights attorney Mohammad Mostafaei visited Delara Darabi in Rasht prison. He reported that Delara was very depressed. Delara told Mostafei that she was tired of the waiting and of her unbearble life in prison.

Delara Darabi's file sent back for corrections

As reported by SCE Campaign on December 10, 2007, file of Delara Darabi had reached the office of Ayatollah Shahrudi, head of Iran's judiciary for final review. It is now reported that the file was sent back to the City of Rasht court where Delara is being kept for some discrepencies. Marjan Laghaee the reporter of Etemaad newspaper in her blog reports that according to Delara's attorney, Abdolsamad Khoramshahi, the descrepencies were not substantive but due to errors in the verdict and its reference to the laws. Khoramshahi anticipates that after correction the case will soon be returned to Shahrudi's office for final decision.

پرونده اعدام دلارا دارابي در دادگستري رشت


شنيده شده پرونده دلارا دارابي دختر نقاش متهم به قتل كه براي اذن اعدام به دفتر هاشمي شاهرودي رفته بود به دليل پاره اي اشكالات به دادگستري رشت بازگردانده شد
وكيل مدافع دلارا ضمن تاييد اين مطلب گفت: اين ايرادات شكلي نبوده و فقط به خاطر نواقصي كه در خود راي وجود داشته است پرونده به دادگستر ي رشت بازگردانده شده است.  احتمالا اين ايرادات به زودي برطرف شده و دوباره پرونده نزد رييس قوه قضاييه ياز گردانده مي شود چرا كه مشكل در استناد به مواد قانوني بوده است. اين به معناي ان نيست كه حكم دلارا تاييد نشده است چرا كه هنوز در مورد اجراشدن و يا نشدن حكم دستوري صادر نشده است

Swedish Foreign Ministery to protest the recent child execution orders

Following SCE's communication with International Committee Against Executions on the executions orders of Ali Mahin-Torabi, Mohammad Latif and Delara Darabi, they informed Nazanin Afshin-Jam that ICAE has contacted the Swedish Foreign Ministry who subsequently notified the Swedish embassy in Teheran.  

They will be following the 3 cases tomorrow via the Swedish EU-membership locally in Tehran and try to arrange a meeting with Iran's foreign ministry to address their concern.

Earlier in October 2007, after prior contacts of ICAE with Swedish Parliament, few members of the Swedish Parliament sent an email to supreme leaders of Islamic regime, Ayatollah Khamenei and Iran's Embassy in Sweden.

In their letter, they wrote: "

"....In regards to the recent report of The High Commissioner for Human Rights and the latest European Union declaration on human rights situation in Iran, we, as social democratic members of the Swedish parliament strongly condemn the brutal assault on human rights in Iran. ".

"Ali Mahin Torabi has been convicted of a murder committed when he was 16 years old and is now at risk of imminent execution, though Iran is a state party to international treaties including the Convention on the Rights of the Child (CRC), which expressly prohibit the execution of child offenders. "

They also demanded leader of Islamic regime to " Stop all executions and abolish execution of children."

They additionally asked him to immediately " release all political prisoners, members of the student movement, the women movement, the workers movement and the social movements. We demand human, social, and political rights and recognition of the right to organize unions, political and social organizations. "

URGENT: Delara Darabi's file sent for approval of execution

Iran's Etemaad newspaper last week reported that the file of Delara Darabi is now at the office of Ayatollah Shahrudi , Iran's head of judiciary for approval of execution.

Delara's attorney Khoramshahi is hoping that Ayatollah Shahrudi would order a new court review of the file.

آخرين فرصت دل آرا براي نجات از اعدام

پرونده دختر نقاش در اختيار رئيس قوه قضائيه قرار گرفت
گروه حوادث؛ پرونده دل آرا دارابي دختر نقاشي که به اتهام قتل دختر عموي پدرش به قصاص محکوم شده است براي صدور اجازه اجراي حکم در اختيار رئيس قوه قضائيه قرار گرفت.

عبدالصمد خرمشاهي وکيل مدافع دل آرا روز گذشته با اعلام اين خبر به خبرنگار ما گفت؛ در پرونده ايرادهايي وجود دارد که نشان مي دهد دل آرا قاتل نيست. از جمله اين ايرادها چپ دست بودن دل آرا است، حال آنکه ضربات وارده به مقتول به گونه يي است که بايد فردي راست دست آنها را زده باشد. به هر حال به زودي نامه يي را به دفتر آيت الله هاشمي شاهرودي مي فرستم و تمام ايرادهايي را که در پرونده وجود دارد متذکر مي شوم و بسيار اميدوارم مشاوران هوشيار رئيس قوه قضائيه به آن توجه کنند تا واقعيت روشن شود. خرمشاهي با تاکيد بر منطبق نبودن اعترافات اوليه دل آرا با واقعيت ادامه داد؛ دل آرا دختري نقاش و داراي روحيه يي بسيار لطيف است و هيچ کدام از خصوصيات روحي و فيزيکي او اجازه ارتکاب قتل را به اين دختر نمي دهد و باز هم تاکيد مي کنم که دل آرا قاتل نيست و در واقع قرباني يک عشق تلخ شده است. دل آرا دارابي که از 17 سالگي در زندان رشت به سر مي برد متهم است با همدستي پسر مورد علاقه اش اميرحسين دخترعموي پدرش را به قتل رسانده است. دل آرا ساعاتي پس از حادثه با تلفن پدرش به پليس دستگير شد و در اداره آگاهي به قتل مهين اعتراف کرد. وي گفت؛ من و اميرحسين براي به دست آوردن پول هاي مهين وارد خانه او شديم و زماني که اين زن قصد داشت برايمان ميوه بياورد من با چاقو از پهلو او را زدم. دل آرا چندي بعد اعترافاتش را پس گرفت و توضيح داد که حادثه به گونه ديگري اتفاق افتاده است. وي گفت؛ من و اميرحسين به هم علاقه مند بوديم و مدتي بود که با هم رابطه داشتيم. چند روز قبل از حادثه اميرحسين به من گفت؛ شخصي يک سند جعلي براي خانه مهين درست کرده و قصد فروش خانه را دارد و به همين بهانه مرا به منزل مهين کشاند. وقتي وارد خانه شديم من براي آوردن ميوه به آشپزخانه رفتم و با صداي فريادهاي مهين متوجه شدم اميرحسين او را با چوب زده است. اميرحسين سپس چاقويي از آشپزخانه برداشت و ضرباتي بر بدن مهين زد. دختر جوان افزود؛ من به درخواست اميرحسين قتل را گردن گرفتم چون او به من گفت دختران زير 18 سال را اعدام نمي کنند اما اگر مشخص شود قاتل اميرحسين است وي حتماً قصاص مي شود. من نيز به خاطر علاقه به او به قتل اعتراف کردم. هر چند انکار وي مورد قبول دادگاه قرار نگرفت و قاضي شعبه اطفال دادگستري رشت او را به قصاص محکوم کرد، اما عبدالصمد خرمشاهي وکيل مدافع دختر نقاش به حکم صادره اعتراض و طي لايحه يي اعلام کرد، دل آرا چپ دست است و امکان وارد آوردن ضربه به سمت راست مقتول آن هم از پشت براي او وجود نداشته است، ضمن اينکه وي تحت تاثير رفتار پدرش هنگام دستگيري و همچنين حرف هاي اميرحسين قتل را بر عهده گرفته، در صورتي که جثه ريز دل آرا و شرايط حاکم بر محل حادثه کاملاً نشان مي دهد قتل کار او نبوده است و حتي دل آرا در اعتراض به رفتار اميرحسين با مهين با چاقو پسر مورد علاقه اش را تهديد کرد تا شايد از قتل جلوگيري کند. وکيل دل آرا همچنين به ايرادات ديگر در پرونده اشاره کرد و خواستار بازسازي مجدد صحنه قتل شد و عنوان کرد بازسازي صحنه قتل مي تواند واقعيت را آشکار کند. در ادامه روند رسيدگي به پرونده با ايرادي که ديوان عالي کشور به حکم دادگاه بدوي وارد کرد، پرونده بار ديگر به دادگاه عمومي فرستاده شد و به رغم وعده يي که قاضي رسيدگي کننده براي بازسازي مجدد صحنه قتل داده بود اين قول عملي نشد و بار ديگر راي بر قصاص دل آرا صادر شد. اين بار حکم صادره در ديوان عالي کشور مورد تاييد قرار گرفت و پرونده براي گذراندن آخرين مرحله قانوني خود نزد آيت الله شاهرودي رئيس قوه قضائيه فرستاده شد؛ در حالي که تاييد حکم از سوي رئيس قوه قضائيه به معناي اجازه اجراي حکم قصاص براي دل آرا است. دختر نقاش و وکيل مدافعش اميدوار هستند با قبول ايرادهاي موجود در پرونده از سوي رئيس قوه قضائيه حکم قصاص متوقف و دختر جوان بار ديگر محاکمه شود. دل آرا که روزهاي پراضطرابي را در زندان مي گذراند، يک بار دست به خودکشي زده بود اما با تلاش مسوولان زندان از مرگ نجات يافت و اکنون به دليل زنداني شدن طولاني مدت، اين دختر جوان دچار بيماري افسردگي نيز شده است.

Delara Darabi and Soghra Najafpour updates


Nasrin Sotoudeh , the attorney of Soghra Najafpour told Nazanin Afshin-Jam that Soghra is still in hiding in fear of execution. Meanwhile Sotoudeh has not yet received any reply to her request for a re-trial submitted to Iran's supreme court. 

Nazanin Afshin-Jam also talked to the mother of Delara Darabi. She was told that Delara's overall prison condition is better than the last one. Her family is allowed to visit her once a week for about 15 to 25 minutes. Delara remains underweight because she does not like the prison food and usually eats biscuits, etc. She is still very depressed but keeps herself occupied with reading. She has not been able to paint o do some of her daily chores beacuse of an injury to her left hand.  Delara has recently become very impatient and wants a resolution to her case.
Delara has asked her parents for some books with paintings of famous painters such as Vincent VanGogh.
Delara Darabi and Soghra Najafpour were friends in prison and the day that Soghra went to say good bye,  she told Delara that she wished that it was Delara who was being freed instead of her . Soghra said that she has spent 18 years of her youth in prison and Delara is much younger and she really does not belong to prison among the some criminals.

There has not been any new changes in Delara Darabi's legal file and like many other alleged child offenders, she is awaiting a response by the head of Iran's judiciary, Ayatollah Hashemi Shahrudi.

Meanwhile Amnesty International  Australia, in its Christmas appeal this year, is focusing on the the subject of child execution in Iran.  21,000 of Amnesty Supporters will be receiving a mail pack with a letter about child executions in Iran, and a letter addressed to the Iran's Head of the Judiciary to sign and send back to Amnesty to be forwarded to Ayatollah Shahrudi.

Delara Darabi will be the main case study and the package also includes a double-sided postcard with two paintings from Delara Darabi which was provided to them this week by Stop Child Executions Campaign.

Delara and prisonmates punished for celebrating her birthday

According to an Iranian reporter, Delara Darabi and few of her prisonmates were punished for celebrating Delara's birthday in prison.

Delara's friends tried to hold a small birthday to cheer up Delara because she has been suffering from depression. Delara's birthday coincided with the same day as the death of first Muslim shia Imam, Ali.  The prison authrities used this excuse to interrupt the small ceremony and took  Delara and her prisonmates for questioning. Meanwhile, Delara and her friends visitation rights were taken away.

Stop Child Executions campaign strongly condemns violation of Delara Darabi's and her prisonmates rights while imprisoned and demand dropping all charges as well as reinstatement of their visitation rights.

Nazanin talks to mothers of Delara Darabi and Reza Alinejad

Nazanin Afshin-Jam spoke with Reza Alinejad's mother this morning who informed her that Reza's file had been sent to Tehran and that decisions were being made. With the lawyers that are helping him in Iran and the support from the International communtiy, they are hoping for a positive outcome. Reza mother's reported that her son is happier since having moved to a different cell in prison. He is a more comfortable with the new inmates that he has come into contact with and says there are not the same amount of fights that used to take place in his old division.
 
Nazanin Afshin-Jam also spoke with Delara Darabi's mother this morning who said that Delara's file seems to be stagnant and they have no idea what is taking place or what will take place. Mrs. Darabi admitted that although Delara seems to be happier with the environment of her new prison cell, she is still not doing very well, because "prison is prison afterall". Her family tries to continue  to bring  hope to Delara.
